1. Introduction and Acceptance

Welcome to Smart Pet API (the “Service”). By accessing or using the Service, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you (“User”, “you”, or “your”) and the operators of Smart Pet API (“we”, “us”, or “our”). We reserve the right to update these Terms at any time. Changes will be effective upon posting to this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Services

Smart Pet API provides access to a data API (Application Programming Interface) that allows users to programmatically retrieve structured data. The Service is provided on a subscription basis with tiered plans offering different usage limits, response formats, and support levels.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will make reasonable efforts to maintain service availability in accordance with the uptime SLA of the plan you have subscribed to.

3. Account Registration and Security

Your account is created automatically upon successful payment. You will receive login credentials by email. You are responsible for:

  • Maintaining the confidentiality of your password and API key.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorized use of your account (contact details available in your dashboard after login).

You must provide accurate, current, and complete information and keep it up to date. Accounts created with false information may be suspended without notice.

4. Subscription Plans and Billing

Access to the Service requires an active paid subscription. By subscribing, you authorize us to charge your payment method via our payment processor (Stripe) on a recurring monthly basis.

4.1 First-Month Discount

All subscription plans include a discounted introductory price for the first billing month. This discount exists to allow you to evaluate the Service with real data before committing to the regular price. From the second billing month onward, the regular plan price applies automatically. No further action is required on your part.

4.2 Billing Cycle

Subscriptions are billed monthly from the date of initial payment. Renewal charges are processed automatically at the start of each new billing period.

4.3 Payment Processing

All payments are processed by Stripe, a PCI-DSS Level 1 certified third-party payment processor. We do not store your credit card number, CVV, or any payment card data on our systems. By providing payment information, you agree to Stripe's Terms of Service and Privacy Policy.

4.4 Failed Payments

If a payment fails, we may suspend access to the Service until outstanding amounts are settled. We will notify you by email and allow a reasonable period to update your payment details.

5. Cancellation Policy

5.1 Early Cancellation (within 10 days)

If you are not satisfied with the Service, you may cancel your subscription within 10 days of the initial payment date and receive a full refund. To request an early cancellation:

  • Contact us via the support email found in your dashboard after login, including your account email and reason for cancellation; or
  • Use the “Cancel Subscription” button in your account dashboard.

Refunds are processed within 5–10 business days to the original payment method.

5.2 Standard Cancellation

You may cancel your subscription at any time after the initial 10-day window. Cancellations take effect at the end of the current billing period. You will continue to have access to the Service until that date, and you will not be charged for the following period. No partial refunds are issued for mid-cycle cancellations.

5.3 How to Cancel

You may cancel at any time from your account dashboard (Account → Subscription → Cancel Subscription), or by contacting us via the support email available in your dashboard after login.

6. API Usage and Restrictions

Your subscription grants you a non-exclusive, non-transferable license to access and use the Smart Pet API API subject to the limits of your selected plan. You agree not to:

  • Exceed the monthly request limit or rate limit of your plan. Requests exceeding your plan limits will be rejected with HTTP 429 responses.
  • Share, resell, sublicense, or redistribute your API key or API access to third parties.
  • Reverse engineer, decompile, or attempt to extract the source code or underlying data infrastructure of the Service.
  • Use the Service in a way that violates any applicable law or regulation, including but not limited to data protection, intellectual property, and anti-spam laws.
  • Use the Service to transmit malware, conduct denial-of-service attacks, or otherwise disrupt the Service or other users.
  • Use automated means to create multiple accounts or circumvent rate limits.

Violation of these restrictions may result in immediate suspension or termination of your account without refund.

7. Uptime and Service Levels

We commit to making reasonable efforts to maintain service availability according to the SLA of your selected plan. SLA credits, if applicable to your plan, are the sole remedy for downtime. We are not liable for downtime caused by:

  • Force majeure events (natural disasters, war, pandemics, etc.).
  • Third-party infrastructure failures outside our reasonable control.
  • Scheduled maintenance (notified in advance).
  • Your own network or software issues.

8. Data and Privacy

We collect and process personal data (such as your name and email address) as necessary to provide the Service. We do not sell your personal data to third parties.

Your API usage data (request counts, timestamps, endpoint usage) is collected to enforce plan limits, display dashboard analytics, and improve the Service.

We may use third-party service providers (including Stripe for payments) who process data on our behalf subject to appropriate data protection agreements. Please refer to our Privacy Policy for full details.

9. Intellectual Property

The Service, including its code, design, branding, documentation, and data delivery infrastructure, is and remains the exclusive property of Smart Pet API. Nothing in these Terms grants you ownership of any intellectual property rights in the Service.

Data retrieved through the API is provided for your use in accordance with the terms of this agreement. You may not redistribute raw API data as a competing data product without our written consent.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

11. Indemnification

You agree to indemnify and hold harmless Smart Pet API and its affiliates, officers, agents, and employees from any claim, demand, or damage, including reasonable attorneys' fees, arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; or (c) your infringement of any third-party right.

12. Termination

Either party may terminate the subscription at any time in accordance with Section 5 (Cancellation Policy). We reserve the right to suspend or terminate your account immediately, without notice or refund, if you breach these Terms, engage in fraudulent activity, or otherwise use the Service in a way that causes harm or legal exposure.

13. Governing Law and Dispute Resolution

These Terms are governed by applicable law. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction, as determined by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on our website at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.
